This paper explores Charles Taylor’s conception of an inclusive liberal polity. It argues that contemporary immigration challenges even Taylor’s inclusive liberalism by revealing that liberalism is inherently exclusionary and that the exclusionary tendency reinforces liberalism’s peculiar ability to cultivate refugees at both the national and transnational levels.

We have witnessed, and in some instance from afar, disasters of all sorts that span the globe from the Caribbean, South and North America, Asia, to Australia and other affected regions of the world. Some of these destabilizing and at times fatal events have resulted in lives lost, forced migration, and a restructuring of the physical, social and economic architecture of the affected parts of the globe. The environment and sociopolitical contexts in which we dwell shape our approach to the world. Islands, following Pádraig Ó Tuama, trigger an openness to other persons and sites. They fuel the comity of their inhabitants, motivate their interconnection with others, and thus sharpen their sense of morality. The Caribbean islands, and the Americas writ large, are also sites of both genocide and of a novel way to embrace the world. The peoples of the Caribbean islands have used the predicaments of (...) isolation, displacement, and genocide to initiate a mode of living that is best articulated, in the contemporary period, through the concept of créolization. The authors considered in this essay have expanded our understanding of the créolization. They have made specific the experiential thread of resilience that undergirds the meaning of créolization. In Condé’s work, the resilience is highlighted through the individual writer’s creativity. Sealy, for her part, expands the meaning of créolization to model a prospective inclusionary polity in the form of a créolizing nation. As we know, nations are not isolated entities; they are part of a conglomeration with other nations. Getachew completes the study to show that the cosmopolitan world that we might aspire to reach can benefit from the post-World War II efforts of Caribbean and African postcolonial nations. In truth, we realize with these authors that a moral and equitable international environment has been the articulated goal of Caribbean peoples since arguably the sixteenth century. It is a goal consonant with all of the perennial humanist ideals of modernity. (shrink)

Cases of intervention in international affairs are often thought justifiable if the intervention is exercised against rogue political leaders and delinquent nation-states. The author offers an argument for the inclusion of an increasingly ubiquitous international agent, the profit generating corporation. This done, the paper argues that a cosmopolitan ethics of responsibility is an attractive mode of evaluation that renders corporations accountable in the international environment. This ethics of responsibility is applied to the particular case of British/Dutch Shell, Inc., in Nigeria (...) to argue the merits of international intervention. (shrink)

Experimental philosophy is the name for a recent movement whose participants use the methods of experimental psychology to probe the way people think about philosophical issues and then examine how the results of such studies bear on traditional philosophical debates. Given both the breadth of the research being carried out by experimental philosophers and the controversial nature of some of their central methodological assumptions, it is of no surprise that their work has recently come under attack. In this paper we (...) respond to some criticisms of experimental philosophy that have recently been put forward by Antti Kauppinen. Unlike the critics of experimental philosophy, we do not think the fledgling movement either will or should fall before it has even had a chance to rise up to explain what it is, what it seeks to do (and not to do), and exactly how it plans to do it. In several accounts of what models are and how they function a specific view dominates. This view contains the following characteristics. First, there is a clear-cut distinction between theories, models and data and secondly, empirical assessment takes place after the model is built. This view in which discovery and justification are disconnected is not in accordance with several practices of mathematical business-cycle model building. What these practices show is that models have to meet implicit criteria of adequacy, such as satisfying (...) theoretical, mathematical and statistical requirements, and be useful for policy. In order to be adequate, models have to integrate enough items to satisfy such criteria. These items include besides theoretical notions, policy views, mathematisations of the cycle and metaphors also empirical data and facts. So, the main thesis of this chapter is that the context of discovery is the successful integration of those items that satisfy the criteria of adequacy. Marcelo Fischborn discusses the significance of neuroscience for debates about free will. Although he concedes that, to date, Libet-style experiments have failed to threaten “libertarian free will”, he argues that, in principle, neuroscience and psychology could do so by supporting local determinism. We argue that, in principle, Libet-style experiments cannot succeed in disproving or even establishing serious doubt about libertarian free will. First, we contend that “local determination”, as Fischborn outlines it, is not a coherent concept. Moreover, determinism is unlikely (...) to be established by neuroscience in any form that should trouble compatibilists or libertarians—that is, anyone who thinks we might have free will. We conclude that, in principle, neuroscience will not be able undermine libertarian free will and explain why these conclusions support a coherent compatibilist notion of causal sourcehood. (shrink)

Emerging infectious diseases such as Ebola, Hendra, SARS, West Nile, Hepatitis E and avian influenza have led to a renewed recognition of how diseases in human beings, wildlife and livestock are interlinked. The changing prevalence and spread of such infections are largely determined by human activities and changes in environment and climate—where the latter are often also caused by human activities. Since the beginning of the 21st century, these insights have been brought together under the heading of OneHealth—a concept that (...) calls for interdisciplinary collaboration between various sciences as well as professional practices to promote and protect the health of human and non-human animals and the natural environment. Just as insights from public health have led to a broadened focus for health policy and medical care, from treating individual patients to protecting and promoting population health, OneHealth calls for an even broader perspective, including a concern for the environment and animals, and for social-cultural factors that affect human, animal and environmental health. OneHealth not only covers collaborative work to understand and control zoonotic diseases, but also other ways in which interactions between animals, plants and humans may positively or negatively impact on each other’s health. Thus, studies in veterinary medicine and environmental sciences may lead to new insights in human medicine, and vice versa. Acknowledgment of the links between environmental, animal and social health is of course not a novel insight. Hippocrates already pointed to the importance of a clean environment as a requirement for good health; the early public health movements emphasized hygienic living conditions including good-quality housing, sewage systems and clean air and water; and the founders of modern medicine such as William Osler and Rudolf Virchow promoted …. Acute exercise consistently benefits both emotion and cognition, particularly cognitive control. We evaluated acute endurance exercise influences on emotion, domain-general cognitive control, and the cognitive control of emotion, specifically cognitive reappraisal. Thirty-six endurance runners, defined as running at least 30 miles per week with one weekly run of at least 9 miles (21 female, age 18-30 years) participated. In a repeated measures design, participants walked at 57% age-adjusted maximum heart rate (HRmax) (range 51-63%) and ran at 70% HRmax (range 64-76%) (...) for 90 minutes on two separate days. Participants completed measures of emotional state and the Stroop test of domain-general cognitive control before, every 30 minutes during, and 30 minutes after exercise. Participants also completed a cognitive reappraisal task after exercise. Functional near-infrared spectroscopy tracked changes in oxygenated and deoxygenated hemoglobin levels in the prefrontal cortex (PFC). Endurance exercise elevated positive emotion and cognitive reappraisal success. Endurance exercise reduced Stroop response time and test-evoked PFC oxygenation during exercise. Results suggest that even at relatively moderate intensities, endurance athletes benefit emotionally from running both during and after exercise, and task-related prefrontal cortex oxygenation reductions do not appear to hinder prefrontal-dependent cognitive control. This paper takes as a starting point a recent development in privacy-debates: the emphasis on social and institutional environments in the definition and the defence of privacy. Recognizing the merits of this approach I supplement it in two respects. First, an analysis of the relation between privacy and autonomy teaches that in the digital age more than ever individual autonomy is threatened. The striking contrast between on the one hand offline vocabulary, where autonomy and individual decision making prevail, and on (...) the other online practices is a challenge that cannot be met in a social approach. Secondly, I elucidate the background of the social approach. Its importance is not exclusively related to the digital age. In public life we regularly face privacy-moments, when in a small distinguished social domain few people are commonly involved in common experiences. In the digital age the contextual integrity model of Helen Nissenbaum has become very influential. However this model has some problems. Nissenbaum refers to a variety of sources and uses several terms to explain the normativity in her model. The notion ‘context’ is not specific and faces the reproach of conservatism. We elaborate on the most promising suggestion: an elaboration on the notion ‘goods’ as it can be found in the works of Michael Walzer and Alisdair Macintyre. Developing criteria for defining a normative framework requires making explicit the substantive goods that are at stake in a context, and take them as the starting point for decisions about the flow of information. Doing so delivers stronger and more specific orientations that are indispensible in discussions about digital privacy. (shrink)

Since the February 2020 publication of the article ‘Flattening the curve’ in The Economist, political leaders worldwide have used this expression to legitimize the introduction of social distancing measures in fighting Covid-19. In fact, this expression represents a complex combination of three components: the shape of the epidemic curve, the social distancing measures and the reproduction number \. Each component has its own history, each with a different history of control. Presenting the control of the epidemic as flattening the curve (...) is in fact flattening the underlying natural-social complexity. The curve that needs to be flattened is presented as a bell-shaped curve, implicitly suggesting that the pathogen’s spread is subject only to natural laws. The \ value, however, is, fundamentally, a metric of how a pathogen behaves within a social context, namely its numerical value is affected by sociopolitical influences. The jagged and erratic empirical curve of Covid-19 illustrates this. Although the virus has most likely infected only a small portion of the total susceptible population, it is clear its shape has changed drastically. This changing shape is largely due to sociopolitical factors. These include shifting formal laws and policies, shifting individual behaviors as well as shifting various other social norms and practices. This makes the course of Covid-19 curve both erratic and unpredictable. (shrink)

The kinds of models discussed in this paper function as measuring instruments. We will concentrate on two necessary steps for measurement: (1) the search of a mathematical representation of the phenomenon; (2) this representation should cover an invariant relationship between the properties of the phenomenon to be measured and observable accociated attributes of a measuring instrument. Therefore, the measuring instrument should function as a nomological machine. However, invariant relationships are not necessarily ceteris paribus regularities, but could also occur when the (...) influence of the environment is negligible. At the height of the COVID-19 crisis in the Netherlands a shortness of intensive care beds was looming. Dutch professional medical organizations asked a group of ethicists for assistance in drafting guidelines and criteria for selection of patients for intensive care treatment in case of absolute scarcity, when medical selection criteria would no longer suffice. This article describes the Dutch context, the process of drafting the advice and reflects on the role of ethicists and lessons learned. We argue that timely (...) interaction between clinical and ethical expertise is necessary since the distinction between medical and non-medical considerations is not as clearcut as sometimes assumed. Furthermore, pragmatic considerations related to the specifics of an epidemic are of importance, for example, in relation to prioritizing health care workers. As a consequence, any protocol already present before the pandemic would need alterations to fit the current situation. The ‘fair innings’ criterion we proposed, rephrased as an argument of intergenerational solidarity, was considered reasonable by professionals as well as patient organizations. While it is desirable to draft ethical guidelines in ‘peacetime’ as a matter of pandemic preparedness, the pressure of an actual crisis facilitates decision-making, although it will also complicate a more democratic approach. Psychologists and neuroscientists extensively rely on computational models for studying and analyzing the human mind. Traditionally, such computational models have been hand-designed by expert researchers. Two prominent examples are cognitive architectures and Bayesian models of cognition. While the former requires the specification of a fixed set of computational structures and a definition of how these structures interact with each other, the latter necessitates the commitment to a particular prior and a likelihood function which – in combination with Bayes’ rule – (...) determine the model's behavior. In recent years, a new framework has established itself as a promising tool for building models of human cognition: the framework of meta-learning. In contrast to the previously mentioned model classes, meta-learned models acquire their inductive biases from experience, i.e., by repeatedly interacting with an environment. However, a coherent research program around meta-learned models of cognition is still missing to this day. The purpose of this article is to synthesize previous work in this field and establish such a research program. We accomplish this by pointing out that meta-learning can be used to construct Bayes-optimal learning algorithms, allowing us to draw strong connections to the rational analysis of cognition. We then discuss several advantages of the meta-learning framework over traditional methods and reexamine prior work in the context of these new insights. (shrink)

In the social sciences we hardly can create laboratory conditions, we only can try to find out which kinds of experiments Nature has carried out. Knowledge about Nature's designs can be used to infer conditions for reliable predictions. This problem was explicitly dealt with in Haavelmo's (1944) discussion of autonomous relationships, Friedman's (1953) as-if methodology, and Simon's (1961) discussions of nearly-decomposable systems. All three accounts take Marshallian partitioning as starting point, however not with a sharp ceteris paribus razor but with (...) the blunt knife of negligibility assumptions. As will be shown, in each account reflection on which influences are negligible, for what phenomena and for how long, played a central role. (shrink)

The European Corporate Sustainability Framework (ECSF) is, among other concepts, based on a phase-wise development approach as described by Clare Graves' Levels of Existence Theory. As much as corporate sustainability has a sequence of adequate interpretations, aligned with each development level, also the notion of business excellence can be defined at multiple levels, as this paper demonstrates. Furthermore, the authors analyze the current EFQM Excellence Model for particular biases towards various development levels and suggest a new and innovative two-step approach (...) to assessing organizational performance with respect to organizational excellence (OE) and corporate sustainability. According to the organization's ambition, the assessment is either limited to a shareholder approach, mainly focusing at optimal usage of resources, or it also includes an additional assessment format based on the stakeholder approach, with specific reference to the organization's performance on the financial, social and ecological bottom line. Accuracy is achieved by calibration. For calibration standards are needed. Then two strategies can be distinguished. One aims at estimating the invariant (structural) equations of the system. A critical aspect of this designing process is the choice of the mathematical objects with which one hopes to capture this phenomenon. This means (...) that one has to assess which of the properties of different kinds of mathematical objects and which combinations of them are most appropriate. The selection of these objects is based on whether their properties enable the model to perform its function. Glenn Harrison [Journal of Economic Methodology, 2013, 20, 103–117] discusses four related forms of methodological intolerance with respect to field experiments: field experiments should rely on some form of randomization, should be disconnected from theory, the concept of causality should only be defined in terms of observables, and the role of laboratory experiments is dismissed. As is often the case, the cause of intolerance is ignorance, as it is here. To acquire knowledge about potential influences, which we need for both (...) the evaluation of internal and external validity of experimental results, we cannot do without theory. A purely empiricist methodology will be unable to give us sufficient understanding of the validity of these results. An account of causality only based on directly observed things, is an account based on factual influences only. Some screening tests for donor blood that are used by blood services to prevent transfusion-transmission of infectious diseases offer relatively few health benefits for the resources spent on them. Can good ethical arguments be provided for employing these tests nonetheless? This paper discusses—and ultimately rejects—three such arguments. According to the ‘rule of rescue’ argument, general standards for cost-effectiveness in healthcare may be ignored when rescuing identifiable individuals. The argument fails in this context, however, because we cannot identify beforehand who will (...) benefit from additional blood screening tests. On the ‘imposed risk’ argument, general cost-effectiveness standards do not apply when healthcare interventions impose risks on patients. This argument ignores the fact that imposing risks on patients is inevitable in healthcare and that these risks can be countered only within reasonable limits. Finally, the ‘manufacturing standard’ argument premises that general cost-effectiveness standards do not apply to procedures preventing the contamination of manufactured medical products. We contend that while this argument seems reasonable insofar as commercially manufactured medical products are concerned, publicly funded blood screening tests should respect the standards for general healthcare. We conclude that these particular arguments are unpersuasive, and we offer directions to advance the debate. (shrink)

The answer to a 'why' question is an explanation. The premises of an explanation have to include invariant relationships, and thus the reliability of such answer depends on whether the domain of invariance of the relevant relationships covers the domain of the question. In this essay I explore the role of dialectics for how social theory can take account of the problem of structure and agency, or, determination and freedom, in a critical and emancipatory way. I discuss the limits and possibilities of dialectical, and of anti-dialectical, criticisms of Hegelian dialectics. For this purpose, I look at Judith Butler’s discussion of dialectics and the concepts of ‘sex’ and ‘gender’ in her writings between 1987 ( Subjects of Desire ; republished 1999) and 1990 ( (...) Gender Trouble , republished 2000). Butler’s book Gender Trouble remains a key text of contemporary feminist theory. Butler formulates in this book a critique of Simone de Beauvoir’s The Second Sex based on her claim that Beauvoir makes a distinction between ‘sex’ and ‘gender’ that implies the notion of the sexed body as a pre-cultural entity. In her earlier writings, though, her evaluation of de Beauvoir had been much more positive. The change in Butler’s evaluation of de Beauvoir is part of her increasing rejection of dialectics: Butler rejected in Gender Trouble any form of Hegelian dialectics with reference to Luce Irigaray’s (1985) claim that it is ‘phallogocentric’. Although Butler subsequently returned to Hegelian themes, she seems never to have revoked this claim made in her most momentous work. I argue that this change in the theoretical structure of Butler’s argument weakens her critique of identity politics and I suggest reading Butler backwards, from Gender Trouble to the more open discussion of dialectics in her earlier texts. Drawing on Adorno’s Negative Dialectics and other formulations of critical theory, I argue that the valid aspects of the critique of Hegelian dialectics can better be formulated as a dialectical critique of dialectics (Adorno; Butler, 1987a) than as a rejection of dialectics (Derrida; Irigaray; Butler, 1990). Retracing the genealogy of Butler’s argument will be a necessary backdrop, too, for evaluating her more recent comments on the Hegelian and ‘Frankfurt School’ traditions such as her Adorno Lectures given in Frankfurt am Main, Germany, in November 2002. According to Suppes, measurement theory, like any scientific theory, should consist of two parts, a set-theoretical defined structure and the empirical interpretation of that structure. An empirical interpretation means the specification – ‘coordinating definitions’ – of a ‘hierarchy of models’ between the theory and the experimental results. But in the case of measurement theory, he defined the relationship between numerical structure and the empirical structure specifically in terms of homomorphism. This is rather a highly restrictive relation between models, and therefore (...) he never succeeded in giving his measurement theory empirical content. The Representational Theory of Measurement conceives measurement as establishing homomorphisms from empirical relational structures into numerical relation structures, called models. There are two different approaches to deal with the justification of a model: an axiomatic and an empirical approach. The axiomatic approach verifies whether a given relational structure satisfies certain axioms to secure homomorphic mapping. The empirical approach conceives models to function as measuring instruments by transferring observations of a phenomenon under investigation into quantitative facts about that phenomenon. These facts (...) are evaluated by their accuracy and precision. Precision is generally achieved by least squares methods and accuracy by calibration. For calibration standards are needed. Then two polar strategies can be distinguished: white-box modeling and black-box modeling. The first strategy of modeling aims at estimating the invariant equations of the phenomenon, thereby fulfilling Hertz’s correctness requirement. The latter strategy of modeling is to use known stable facts about the phenomenon to adjust the model parameters, thereby fulfilling Hertz’s appropriateness requirement. For this latter strategy, the requirement of models as homomorphic mappings has been dropped. Where one will find the axiomatic approach more often used for measurement in the laboratory, the empirical approach is more appropriate for measurement outside the laboratory. The reason for this is that for measurement of phenomena outside the laboratory, one also needs to take account of the environment to achieve accurate results. Environments are generally too relation-rich for an axiomatic approach, which are only applicable for relation-poor systems. The white-box modeling strategy, reflecting the complexity of the environment due to its correctness requirement, will, however, lead to immensely large models. To avoid this problem, modular design is an appropriate strategy to reduce this complexity. Modular design is a grey-box modeling strategy. Grey-box models are assemblies of modules; these are black boxes with standard interface. It should be noted that the structure of the assemblage need not be homomorphic to the relations describing the interaction between phenomenon and environment. These three modeling strategies map out the possible designs for computer simulations as measuring instruments. Whether a simulation is based on a white-box, grey-box or black-box model is only determined by the relationship between the phenomenon and its environment and not by e.g. its materiality or physicality. Many nursing homes have an influenza vaccination policy in which it is assumed that express (proxy) consent is not necessary. Tacit consent procedures are more efficient if one aims at high vaccination rates. In this paper I focus on incompetent residents and proxy consent. Tacit proxy consent for vaccination implies a deviance of standard proxy consent requirements. I analyse several arguments that may possibly support such a deviance. The primary reason to offer influenza vaccination is that vaccinated persons have a (...) significantly reduced risk of getting the flu. This reason however cannot support the assumption that each nursing home resident is ‘better off ’ if she is vaccinated. Neither can it support tacit proxy consent policies. More promising are arguments that take the collective nature of infectious diseases into account. A potentially strong, but ultimately insufficient, argument for non‐express consent is that vaccination contributes to prevention of harm to others. Other arguments emphasise the importance of group protection: herd immunity. I discuss three collective reasons for aiming at herd immunity: solidarity, a common interest in reducing the risk of illness, and a common interest in the prevention of an influenza outbreak. The latter argument appears to be most important. An outbreak is not just detrimental to the health of residents; it is detrimental to their everyday social life as well. Outbreaks can be seen as a collective evil. My analysis shows that there are valid (though not necessarily sufficient) moral arguments for a tacit proxy consent policy. (shrink)

Generally, rational decision-making is conceived as arriving at a decision by a correct application of the rules of logic and statistics. If not, the conclusions are called biased. After an impressive series of experiments and tests carried out in the last few decades, the view arose that rationality is tough for all, skilled field experts not excluded. A new type of planner's counsellor is called for: the normative statistician, the expert in reasoning with uncertainty par excellence. To unravel this view, (...) the paper explores a specific practice of clinical decision-making, namely Evidence-Based Medicine. This practice is chosen, because it is very explicit about how to rationalize practice. The paper shows that whether a decision-making process is rational cannot be assessed without taking into account the environment in which the decisions have to be taken. To be more specific, the decision to call for new evidence should be rational too. This decision and the way in which this evidence is obtained are crucial to validate the base rates. Rationality should be model-based, which means that not only the isolated decision-making process should take a Bayesian updating process as its norm, but should also model the acquisition of evidence (priors and tests results) as a rational process.
